200 DA, ADAs posts lying vacant in Punjab, Haryana and Chandigarh

Chandigarh Amidst the Punjab and Haryana High Court’s claims of providing speedy justice to litigants, the state governments are yet to fill up vacant posts of public prosecutors. Over 200 public prosecutors posts are lying vacant in Punjab, Haryana and Chandigarh. The High Court has already taken suo motu notice of the shortage of public
prosecutors in Punjab, Haryana and Chandigarh, after the issue came to fore at a meeting of the District and Sessions Judges of both the states and the UT at the Chandigarh Judicial Academy on March 3. In Punjab, there are 135 posts of public prosecutors that are yet to be filled up by the government. There are only 223 attorneys against 358 sanctioned posts. The strength includes 38 district attorneys, 100 deputy district attorneys and 220 assistant district attorneys. There are 96 more posts of attorneys that are sanctioned by the council of ministers according to a decision dated on April 5, 2013. In a recent hearing of the case, it was admitted by the state government that only 209 attorneys and district attorneys, 52 deputy district attorneys and 137 assistant district attorneys are working presently. Additionally, 14 surplus assistant district attorneys are transferred from the Punjab Legal Services Authority vide order dated May 14. Similarly in Haryana, there are 81 sanctioned posts of deputy district attorney notified as the public prosecutors out of which 56 are working in different District Session Divisions. Thus, there is a short fall of 25 public prosecutors. There are also 257 sanctioned posts of assistant district attorneys out of which 178 posts are duly notified as the assistant public prosecutors. Hence, there is a short fall of 79 assistant public prosecutors. The state government has already sent requisition for filling up 136 posts of assistant district attorneys to Haryana Public Service Commission. There is a regular cadre of service consisting of the district attorneys, deputy district attorneys and assistant district attorneys. The district attorneys and deputy district attorneys have been duly notified as the public prosecutors and assistant district attorneys prosecutors. The public prosecutors and deputy public prosecutors are posted to conduct the cases on behalf of the state of Haryana in the courts of Sessions Judges, Additional District and Sessions Judge and Judicial Magistrates. The post of district attorney in each session division is sanctioned in Haryana. In case of Chandigarh, a recent reply placed before the High Court by the UT Administration states that at present there are 7 posts of deputy district attorneys on the cadre strength of Law and Prosecution Department. Out of these 4, the deputy district attorneys have already been posted in courts of Additional District and Sessions Judges.
